Abstract

This study analyzes changes in the inheritance system of Pusako Tinggi assets and their impact on the Minangakabau customary inheritance system. As empirical legal research, it addresses the changes in the behavior of the Minangkabau indigenous people related to inheritance in Pusako Tinggi assets. To gain a better understanding of the main problem, philosophical, sociological, and case approaches were used. Data were collected by observation, interview, and document study, and they were analyzed in a descriptive-qualitative manner with an inductive conclusion. The results of the study revealed that the following factors caused some changes in the inheritance system of Pusako Tinggi assets in the Minangkabau indigenous people: (1). The influence of the Islamic inheritance system; (2) Registration and Granting of Higher Inheritance Rights; (3) Pusako Tinggi land trade; (4) The weakening power of mamak. Changes in the inheritance system for Pusako Tinggi assets in the Minangkabau people have an impact on: (1) elimination of nephews’ inheritance rights; (2) changes in Mamak’s responsibilities; (3) no addition of pusako tinggi; (4) the development of migratory culture; (5) the use of Pusako Tinggi land for investment.Keywords: inheritance system, Pusako Tinggi, Minangkabau Perubahan Sistem Pewarisan Aset Pusako Tinggi Dan Dampaknya Terhadap Sistem Pewarisan Adat Minangkabau AbstrakKajian ini menganalisis perubahan sistem pewarisan harta benda Pusako Tinggi dan dampaknya terhadap sistem pewarisan adat Minangkabau. Sebagai penelitian hukum empiris, membahas tentang perubahan perilaku masyarakat adat Minangkabau terkait pewarisan harta benda Pusako Tinggi. Untuk mendapatkan pemahaman yang lebih baik tentang masalah utama, pendekatan filosofis, sosiologis, dan kasus digunakan. Data dikumpulkan melalui observasi, wawancara, dan studi dokumen, dan dianalisis secara deskriptif-kualitatif dengan kesimpulan induktif. Hasil penelitian mengungkapkan bahwa faktor-faktor berikut menyebabkan terjadinya perubahan sistem pewarisan harta kekayaan Pusako Tinggi pada masyarakat adat Minangkabau: (1). Pengaruh sistem waris Islam; (2) Pendaftaran dan Pemberian Hak Waris yang Lebih Tinggi; (3) perdagangan tanah Pusako Tinggi; (4) Melemahnya daya mamak. Perubahan sistem pewarisan harta kekayaan Pusako Tinggi pada masyarakat Minangkabau berdampak pada: (1) penghapusan hak waris keponakan; (2) perubahan tanggung jawab Mamak; (3) tidak ada penambahan pusako tinggi; (4) pengembangan budaya migrasi; (5) pemanfaatan tanah Pusako Tinggi untuk investasi.Kata Kunci: sistem pewarisan, Pusako Tinggi, Minangkabau

Abstract

The main responsibility of the Indonesian government is to protect its citizens, including in the healthcare sector. However, the Government of Kebumen Regency has not fully implemented the responsibility. The research questions are (1) what were the policies of the local government of Kebumen Regency concerning the distribution of healthcare workforce during the COVID-19 Pandemic? (2) How do legal theories address any issues related to the local government policies concerning the distribution of healthcare workforce during the COVID-19 Pandemic? This was a qualitative descriptive study which used a sociological or empirical non-doctrinal method. The study was carried out in Kebumen Regency and the sources consisted of the Head of the Healthcare Agency, one human resource analyst, and one healthcare worker. This study operated under various theories, including Aristotelian political ethics and the will to power by Friedrich Wilhelm Nietzsche. This study found that the regent of Kebumen Regency had not demonstrated concern in distributing healthcare workforce to healthcare facilities during the COVID-19 Pandemic. The policy issued by the government of Kebumen Regency concerning the distribution of healthcare workforce is considered inappropriate. The political ethics theory shows that local government could issue policies concerning the distribution of healthcare workforce regardless of the existing needs for healthcare human resources. The will to power theory shows that local government policies can be considered as either appropriate or inappropriate policy.Keywords: distribution, healthcare workforce, healthcare policy, local government. Kebijakan Pemerintah Daerah Dalam Distribusi Tenaga Kesehatan Selama Pandemi Covid-19 (Kabupaten Kebumen) AbstrakTanggung jawab utama pemerintah Indonesia adalah melindungi warga negaranya, termasuk di bidang kesehatan. Namun, Pemerintah Kabupaten Kebumen belum sepenuhnya melaksanakan tanggung jawab tersebut. Pertanyaan penelitian adalah (1) bagaimana kebijakan pemerintah daerah Kabupaten Kebumen terkait pendistribusian tenaga kesehatan pada masa Pandemi COVID-19? (2) Bagaimana teori hukum menyikapi setiap isu yang terkait dengan kebijakan pemerintah daerah tentang distribusi tenaga kesehatan selama Pandemi COVID-19? Penelitian ini merupakan penelitian deskriptif kualitatif yang menggunakan metode sosiologis atau empiris non-doktrinal. Kajian dilakukan di Kabupaten Kebumen dan narasumber terdiri dari Kepala Dinas Kesehatan, satu orang analis sumber daya manusia, dan satu orang tenaga kesehatan. Studi ini beroperasi di bawah berbagai teori, termasuk etika politik Aristotelian dan keinginan untuk berkuasa oleh Friedrich Wilhelm Nietzsche. Studi ini menemukan bahwa Bupati Kabupaten Kebumen kurang memperhatikan distribusi tenaga kesehatan ke fasilitas kesehatan selama masa pandemi COVID-19. Kebijakan yang dikeluarkan oleh Pemerintah Kabupaten Kebumen tentang pendistribusian tenaga kesehatan dinilai kurang tepat. Teori etika politik menunjukkan bahwa pemerintah daerah dapat mengeluarkan kebijakan tentang distribusi tenaga kesehatan terlepas dari kebutuhan sumber daya manusia kesehatan yang ada. Teori kehendak untuk berkuasa menunjukkan bahwa kebijakan pemerintah daerah dapat dianggap sebagai kebijakan yang tepat atau tidak tepat.Kata Kunci: distribusi, tenaga kesehatan, kebijakan kesehatan, pemerintah daerah.

Abstract

There are a legal vacuum and contradictory provisions in the Marriage Law, which states that it is not permissible for an Indonesian citizen to have an interreligious marriage. It has been requested for judicial review through the Decision of the Constitutional Court No. 68/PUU-XII/2014. Article 2 paragraph (1) of Law No. 1 of 1974 on Marriage stated that marriage is legitimate if the parties concerned have similar religions and beliefs. Moreover, it has become more obvious through judicial review of the Decision on Indonesian Constitutional Court Number 68/PUU-XII/2014, which decided that Article 2 paragraph (1) Law No. 1 of 1974 which amendment by Law No. 16 of 2019 required similarity in religions and beliefs of the marriage concerned parties are not necessary to do a judicial review. On interfaith marriage, the application proved that the judge on the district court’s decisions stated that Law No. 1 of 1974 on Marriage is not regulated, not emphasized, and not containing regulation of any sort about interfaith marriage. It’s proven in most judges’ court considerations of interreligious marriage around 2010 – 2021. This study takes two research formulations such as how a legal vacuum in interreligious marriage happens and how the judges in the court consider the law of interreligious marriage. This research uses a normative method which uses a conceptual and law approach. This research results that judges always consider interreligious marriages as a legal vacuum, it happened because the law that marriages do not clearly determine textually in law no. 1 of 1974. Therefore, even if clarified by Constitutional Court is clearly but practically interpreter different by judges in district court.Keywords: legal vacuum, interreligious marriage, not emphasized, court decision Kekosongan Hukum Perkawinan Beda Agama Di Indonesia: Kajian Tentang Pertimbangan Hakim Dalam Putusan Pengadilan Perkawinan Beda Agama 2010 -2021 AbstrakAdanya kekosongan hukum dan ketentuan yang kontradiktif dalam UU Perkawinan yang menyatakan bahwa warga negara Indonesia tidak boleh melakukan perkawinan beda agama. Telah dimintakan uji materil melalui Putusan Mahkamah Konstitusi Nomor 68/PUU-XII/2014. Pasal 2 ayat (1) Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa perkawinan sah apabila yang bersangkutan mempunyai kesamaan agama dan kepercayaan. Apalagi, hal itu semakin nyata melalui uji materil Putusan Mahkamah Konstitusi Republik Indonesia Nomor 68/PUU-XII/2014 yang memutuskan Pasal 2 ayat (1) UU No 1 Tahun 1974 yang diubah dengan UU No 16 Tahun 2019. syarat kesamaan agama dan kepercayaan dari pihak yang bersangkutan dalam perkawinan tidak perlu dilakukan uji materiil. Tentang perkawinan beda agama, permohonan tersebut membuktikan bahwa hakim pada putusan pengadilan negeri menyatakan bahwa Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan tidak diatur, tidak ditekankan, dan tidak memuat pengaturan apapun tentang perkawinan beda agama. Hal ini terbukti pada sebagian besar pertimbangan hakim terhadap perkawinan beda agama sekitar tahun 2010 – 2021. Kajian ini mengambil dua rumusan penelitian yaitu bagaimana terjadi kekosongan hukum dalam perkawinan beda agama dan bagaimana hakim di pengadilan mempertimbangkan hukum perkawinan beda agama. Penelitian ini menggunakan metode normatif yang menggunakan pendekatan konseptual dan hukum. Hasil penelitian ini bahwa hakim selalu menganggap perkawinan beda agama sebagai kekosongan hukum, hal itu terjadi karena undang-undang perkawinan tidak secara jelas menentukan secara tekstual dalam undang-undang no. 1 Tahun 1974. Oleh karena itu, kalaupun diklarifikasi oleh Mahkamah Konstitusi secara jelas tetapi secara praktis penafsirnya berbeda dengan para hakim di Pengadilan Negeri.Kata Kunci: kekosongan hukum, perkawinan beda agama, tidak ditekankan, putusan pengadilan

Abstract

This research is developed from the author's findings of ambiguity in recent philosophical aspects of the application of Islamic law in Indonesia. Accordingly, it is crucial to immediately reform the ijtihad of Islamic law in Indonesia, because the practice is no longer in line with maqâshid al-syarî'ah and the principles of Islamic law. This can be seen from the emergence of civil disobedience toward Islamic law fatwas issued by fatwa institutions in IndonesiaThe purpose of this study is to find answers to the problems specified in the formulation of the problem. This research is a descriptive-normative research or library research that uses content analysis of the data obtained. In addition to using a conceptual approach, this study also uses a maqashidi approach (Maqâshid-Based Ijtihad) to answer the problem studied. The results of this study are: First, there is philosophical confusion regarding the application of Islamic law in Indonesia which includes ontological, epistemological, and axiological confusion. Second, maqâshid al-syarî'ah known as al-ushûl al-khamsah includes the maintenance of religion (hifz al-dn), life (hifz al-nafs), lineage (hifz al-nasab), mind (hifz al-aql), and property (hifz al-mȃl), as the dharûriyyah, hȃjiyyah and tahsȋniyyah level. Meanwhile maqâshid al-'ammah includes the following universal maqâshid principles; nature (al-fiṭroh), tolerance (al-samâhah), benefit (al-maslahah), equality (al-musâwah), and freedom (hurriyâh). Third, reformulation of Islamic law in Indonesia with the maqâshid al-syarî'ah approach can be achieved through two constructs, namely the integration of legal texts with al-ushûl al-khamsah and integration of legal texts with maqâshid al-syarî'ah al-'ammah.Keywords: maqâshid al-syari'ah, reformulation, Islamic law, maslahah, justice Konstruksi Ijtihad Hukum Islam Berdasarkan Pendekatan Maqâshid Al-Syarî'Ah Dalam Konteks Indonesia AbstrakPenelitian ini dikembangkan dari temuan penulis tentang ambiguitas aspek filosofis penerapan hukum Islam di Indonesia belakangan ini. Sejalan dengan itu, sangat penting untuk segera mereformasi ijtihad hukum Islam di Indonesia, karena praktiknya sudah tidak sejalan lagi dengan maqâshid al-syarî'ah dan prinsip-prinsip hukum Islam. Hal ini dapat dilihat dari munculnya pembangkangan sipil terhadap fatwa hukum Islam yang dikeluarkan oleh lembaga fatwa di Indonesia. Tujuan dari penelitian ini adalah untuk menemukan jawaban atas permasalahan yang dirumuskan dalam rumusan masalah. Penelitian ini merupakan penelitian deskriptif-normatif atau penelitian kepustakaan yang menggunakan analisis isi terhadap data yang diperoleh. Selain menggunakan pendekatan konseptual, penelitian ini juga menggunakan pendekatan maqashidi (Ijtihad Berbasis Maqâshid) untuk menjawab permasalahan yang diteliti. Hasil penelitian ini adalah: Pertama, adanya kerancuan filosofis penerapan hukum Islam di Indonesia yang meliputi kerancuan ontologis, epistemologis, dan aksiologis. Kedua, maqâshid al-syarî'ah yang dikenal dengan al-ushûl al-khamsah meliputi pemeliharaan agama (hifz al-dn), jiwa (hifz al-nafs), keturunan (hifz al-nasab), akal (hifz al-aql). ), dan harta (hifz al-mȃl), sebagai tingkatan dharûriyyah, hȃjiyyah dan tahsȋniyyah. Sedangkan maqâshid al-'ammah meliputi prinsip-prinsip maqâshid universal berikut ini; alam (al-fiṭroh), toleransi (al-samâhah), manfaat (al-maslahah), persamaan (al-musâwah), dan kebebasan (hurriyâh). Ketiga, reformulasi hukum Islam di Indonesia dengan pendekatan maqâshid al-syarî'ah dapat dicapai melalui dua konstruksi, yaitu integrasi teks hukum dengan al-ushûl al-khamsah dan integrasi teks hukum dengan maqâshid al-syarî'ah al -'ammah.Kata Kunci: maqâshid al-syari'ah, reformulasi, hukum Islam, maslahah, keadilan

Abstract

This research aims to identify the licensing authority over architectural works and modification of designated Cultural Heritages. In addition, this research examines the antinomy of legal concepts, including the antinomy of the legal concept of a licensing authority, the antinomy of the legal concept of modification of creation, and the antinomy of the legal concept of cultural heritage. With normative research, this study reveals that there is no legal certainty, between the local and central government, concerning licensing authority to cultural heritage building adaptation. There is no such a unitary system or firm and clear SOPs, which has resulted in the demolition and destruction of cultural heritage buildings. There are differences of opinion regarding the authority to permit the alteration of architectural works of cultural heritage buildings that have been stipulated. Permits for the restoration of cultural heritage buildings are obtained not through a building permit but through BPPM DIY (Licensing and Investment Service). These permits include restoration permits, adaptation permits, and development permits, especially for revitalization and utilization. There is no balance between moral and economic rights of the owner of the cultural heritage building. The preservation is more likely to emphasize moral rights but still overlooking the economic rights of the creator/owner.Keywords: licensing authority, architectural work, adaptation, cultural heritage building. Konsep Otoritas Perizinan Modifikasi Karya Arsitektur Bangunan Cagar Budaya AbstrakPenelitian ini bertujuan untuk mengidentifikasi kewenangan perizinan atas karya arsitektur dan modifikasi Cagar Budaya yang ditetapkan. Selain itu, penelitian ini mengkaji antinomi konsep hukum, antara lain antinomi konsep hukum otoritas perizinan, antinomi konsep hukum modifikasi ciptaan, dan antinomi konsep hukum warisan budaya. Dengan kajian normatif, kajian ini mengungkapkan bahwa belum ada kepastian hukum, antara pemerintah daerah dan pusat, mengenai kewenangan perizinan terhadap adaptasi bangunan cagar budaya. Tidak ada sistem kesatuan atau SOP yang tegas dan jelas sehingga mengakibatkan pembongkaran dan perusakan bangunan cagar budaya. Terdapat perbedaan pendapat mengenai kewenangan izin perubahan karya arsitektur bangunan cagar budaya yang telah ditetapkan. Izin pemugaran bangunan cagar budaya diperoleh bukan melalui izin mendirikan bangunan melainkan melalui BPPM DIY (Dinas Perizinan dan Penanaman Modal). Izin tersebut meliputi izin restorasi, izin adaptasi, dan izin pembangunan, terutama untuk revitalisasi dan pemanfaatan. Tidak ada keseimbangan antara hak moral dan ekonomi pemilik bangunan cagar budaya. Pelestarian tersebut lebih cenderung mengedepankan hak moral namun tetap mengabaikan hak ekonomi pencipta/pemilik.Kata Kunci: perizinan, karya arsitektur, adaptasi, bangunan cagar budaya.

Abstract

This study describes and analyzes the urgency of harmonizing the exclusive authority of State Administrative Court as stipulated in the State Administrative Court Law and Non-State Administrative Court Law, and how to do this harmonization in relation to the implementation of legality principles, the theory of hierarchical regulations, and laws on the establishment of laws and regulations. As normative research using statutory and conceptual approaches, this research used a descriptive qualitative analytical method. It is expected that the results of this research can contribute to the development of Constitutional law and State Administrative Law, as well as to contribute ideas to policymakers in making and formulating various regulations related to appropriate methods to overcome disharmony in regulating the exclusive authority of the State Administrative Court to ensure that the law issued on the exclusive authority of the State Administrative Court meets society’s needs for good laws and regulations. This study concluded the following points: first, it is necessary to harmonize the State Administrative Court Law and laws other than State Administrative Court on the exclusive authority of the State Administrative Court to avoid any overlap to ensure harmonization of the laws. Secondly, the usual drafting method is more appropriate than the omnibus method because we only need to amend the State Administrative Court Law, while the other laws remain unamended.Keywords: harmonization, exclusive administrative court authority, state administrative court law Harmonisasi Undang-Undang Peratun Dan Undang-undang Lainnya Mengenai Kewenangan Eksklusif Peradilan Tata Usaha Negara AbstrakKajian ini mendeskripsikan dan menganalisis urgensi harmonisasi kewenangan eksklusif PTUN sebagaimana diatur dalam UU PTUN dan UU PTUN, serta bagaimana harmonisasi tersebut dalam kaitannya dengan penerapan asas legalitas, teori peraturan hirarkis, dan undang-undang tentang pembentukan undang-undang dan peraturan. Sebagai penelitian normatif dengan pendekatan perundang-undangan dan konseptual, penelitian ini menggunakan metode deskriptif analitis kualitatif. Hasil penelitian ini diharapkan dapat memberikan kontribusi bagi perkembangan hukum Tata Negara dan Hukum Tata Negara, serta dapat memberikan sumbangsih pemikiran kepada pembuat kebijakan dalam membuat dan merumuskan berbagai peraturan terkait dengan cara yang tepat untuk mengatasi disharmoni dalam mengatur kewenangan eksklusif DPR. Peratun untuk memastikan bahwa undang-undang yang dikeluarkan atas kewenangan eksklusif Peratun memenuhi kebutuhan masyarakat akan peraturan perundang-undangan yang baik. Kajian ini menyimpulkan beberapa hal sebagai berikut: pertama, diperlukan harmonisasi UU Peratun dengan undang-undang selain Peratun yang menjadi kewenangan eksklusif PTUN agar tidak terjadi tumpang tindih untuk menjamin harmonisasi undang-undang. Kedua, metode penyusunan biasa lebih tepat daripada metode omnibus karena kita hanya perlu mengubah UU Peratun, sedangkan undang-undang lainnya tetap tidak berubah.Kata Kunci: harmonisasi, kewenangan PTUN eksklusif, hukum PTUN
